A Mombasa businessman has written to the Independent policing oversight Authority ( IPOA) seeking for investigations into allleged interference by senior police officers over ownership dispute on a prime property.

The matter had been reported at Makupa police station under OB number,37/1/6/2024

Mohammed Madhubuti who is the owner of plot number XV/143 now claims that Makupa police station commanding officer,issued orders to his officer to supervise the breaking of the disputed property using goons.

“The said OCS alongside the investigating officer ordered for the forcible detainer of my property despite there being a court of appeal judgment that indicated the rightful owners of the property,”he stated.

He informed IPOA that the actions of the OCS and the investigating officer in the case needs to be investigated since they openly showed biasness and had received money from the Pakistani nationals who have occupied the premises illegally.

“On June this year l reported a case of people having invaded my premises without my consent,despite there being various notices to vacate,the OCS accompanied by his officers forcefully evicted me from my property despite having proof of being the rightful owner,”he stated.

In the dispute that was recently resolved by the court of appeal,following a hearing of application filed by Lamu Marine and Allied products Limited in a plot number Mombasa block XV/143 currently occupied by Pakistan motor vehicles dealers namely Axel Motors centre Limited have declined to vacate the plot despite the court of appeal issuing orders to the rightful owners.

According to Madhuti m ,senior police officers in Mombasa are working in chaoots with the Pakistani nationals to frustrate his efforts to occupy the premises.

“After l reported the matter to police l received calls instructing me to have dialogue with the Pakistani nationals currently occupying the building,however days later the area OCS ordered his officers to break into the building and allow operations of the motor vehicle yard in defiance of the court of appeal ruling ,”he added

He now wants the Authority to investigate the conduct of all the police officers involved in the exercise claiming that they were biased since he was able to produce documents to proof ownership of the disputed plot.
