A cash bail that had been deposited with police to facilitate the release of a couple facing assault charges has gone missing.

The suspects, Anne Kinanu alongside Emilio Fioravanti had deposited kshs 40,000 following an alleged assault case against American national Philip Andrew King.

According to a written letter addressed to the office of the ODPP and copied to the DCI officers in Malindi by the accused persons’ lawyer namely, John Magiya has raised concerns that his clients were yet to get a refund of the cash bail following arraignment in court eight months ago.

“The accused persons while in court in May this year, it was established that the duo had paid police cash bail of kshs20,000 each which they were promised to be issued with a receipt of the same amount later, however it did not happen,”reads part of the letter.

He states that the prosecution alongside the investigating officer in the matter confirmed before the court that the money was yet to be surrendered to the suspects .

“It is a common practice that once parties take plea such amount has to be brought to the court for onward surrender of transmission to the respective parties,”he stated.

He further urged the office of the ODPP to look into the whereabouts of the money and have it refunded to the accused persons.

“Your office undertakes to look into the same, therefore establish if the cash will be returned to the suspects by June this year before the next hearing,” Magiya wrote.

The suspects had been arrested on October 10, 2023 by DCI officers drawn from Malindi police station.

The matter will be mentioned on June 7 this year.
