A Mombasa Businessman accused of defiling a minor inside his car while parked outside a petrol station has been charged.

Charles Onderi from Likoni was yesterday arraigned before Mombasa senior resident magistrate Hon.Rita Orora to answer the charges of defilement, contrary to section 8(1) of the sexual offenses Act No.3 of 2006.

The particulars of the case being that on April 30 this year at Petro filling station next to ferry centre in Likoni sub county within Mombasa county, Onderi intentionally and unlawfully defiled LC a child aged 17 years.

He further faced a second count of committing an indecent act with a child contrary to section 11(1) of the sexual offenses Act.

The court heard that the suspect had on April 31 lured the minor into his vehicle and threathened her that he was a DCI officer and no one would question his actions if she dared reveal the secret.

The court also heard that moments before he defiled the victim he fueled his car and paid ksh.1,000 for the fuel through his Mpesa before moving to the parking lot of Petro filling station where he committed the crime.

“He went to the back seat where the minor was seated, he asked her whether she can keep a secret if he had sex with her and he would give her anything she wants.

The minor was shocked and became nervous, he further told her that she should not be afraid of anything since he was a DCI officer and always armed with a gun in his vehicle. He pulled her to lie on the vehicle seat, he lied on top of her and pulled up her dress, removed her inner pants and defiled her’ police documents revealed in part.

Onderi was later arrested following public outcry after he attempted to interfere with investigations by offering kshs50, 000 to the minor’s mother have the matter settled outside court.

“Moments before defiling the minor he removed his gun and threatened to kill her Incase she did not cooperate ,after defiling her he opened the door and asked her to leave after offering her Kshs300,” police statement read further.

Police documents presented in court further revealed that , Onderi had lured the victim alongside her younger sister and the duo claim that he had requested them to clean his house located at Vanga estate where he was set to open a new business however moments after their arrival he sent the younger sister back to collect Washing soap from one of his shop remaining with the victim at the scene of crime.

He however denied all the charges labeled against him and was released on a kshs200,000 bond with one surety of similar amount.

The matter was mentioned on 27/05/2024 for pretrial purposes.
