A middle aged man has been sentenced to ten years in prison by a Mombasa court.

Mombasa Senior principal magistrate Martin Rabera sentenced Omari Ngomi after he found him guilty of defiling a 15 year old minor.

The particulars of the offence being that on diverse dates between September 27 and 29,2020 at Miritini area in Jomvu sub county within Mombasa county the suspect defiled the victim.

The accused was arrested and charged on September 30, 2020 where he bleaded not guilty to the charges.

Rabera in his judgement said that the evidence presented before his court by the victim indicated that the accused was positively identified as the one who defiled the school girl. He further said that the accused’s evidence was baseless and lacked any support.

The girl, in her testimony revealed that, the suspect who is a bodaboda operator had met and offered her a lift while she was on her way to church before he lured her to a hotel in a nearby local Kitui market where he bought lunch for her.

The girl also said that, it’s after they had left the hotel that the accused took her to his house where he committed the offence repeatedly throughout the night.

The prosecution records read by prosecutor Barbara Sombo however indicated that accused had no any other criminal history and this was his first offense.

“The accused person has no previous criminal records and can therefore be treated as a first time offender” Sombo noted.

Taking all the evidence produced in court into account, magistrate Martin Rabera sentenced Ngomi to a ten years improvement for defiling the child contrary to section 8(1) as read with sub section 8(2) of the sexual offense act no.3 of 2006.

“Having analysed the evidence and testimonies on record , the court has found you guilty of the offense against the minor and i therefore sentence you to serve ten years in prison” Rabera said in his judgment.

The Accused was allowed 14 days to appeal his sentence.
